The Statutes of Pompeu Fabra University, primarily articles 57 and 58, define the functions of the general manager. Under Article 58(g), in addition to those assigned, the general manager’s functions shall include those assigned or delegated by other bodies.

To achieve a better distribution of the functions and powers, the resolution by the rector of 10 March 2023 on the delegation of powers to the general manager assigned a series of additional powers to the general manager, including the delegation of powers in certain matters.

Whereas the position of general manager became vacant by the resolution of 4 September 2024, the rector proceeded to revoke the powers assigned or delegated thereto.

Whereas a new general manager has been appointed, to achieve a better distribution of the functions and powers, it is once again necessary to assign powers to the general manager, including powers delegated thereto by the rector.

Therefore, by virtue of articles 52 and 58 of the Statutes of Pompeu Fabra University, and in view of the laws governing administrative procedure and the legal system applicable to the University,

I HEREBY DECIDE:

Article 1. In addition to those granted thereto under articles 57 and 58 of the Statutes of Pompeu Fabra University, the general manager shall exercise the following powers:

Concerning teaching and research staff management:

  • Report the hiring of teaching staff to the competent educational administration for the purposes of staff registration.
  • Grant service fees for attending thesis readings, teaching staff access contests and other similar activities organized by other universities or authorities, and request from other universities those of their teaching staff.
  • Authorize the leaves of absence and holidays to which teaching staff are entitled under the current legislation.
  • Decide on the recognition of three-yearly increments and prior services to the Administration.
  • Authorize the payment of compensation for any anticipated travel or initial relocation expenses.

Concerning property management:

  • Represent the University in any administrative actions required to obtain licences and the management of planning instruments before the Barcelona Municipal Council and, where applicable, before the Government of Catalonia, in relation to the physical location of the University.
  • Represent the University in any administrative actions required to record diagnostic medical and veterinary x-ray facilities and radioactive facilities in the relevant registers, modify data or report the decommissioning of such facilities.
  • Enter into contracts for the rental of premises.
  • Enter into contracts for the rental of general equipment and the purchase of software licences.
  • Sign agreements or contracts for the management of university halls of residence.
  • Enter into contracts for the transfer of exploitation rights for teaching materials.
  • Authorize or grant the use of public domain property.

Of a general nature:

  • The University’s institutional planning and administrative organization.
  • The policy on material resources, information systems and support in the policy on electronic administration.
  • Occupational hazards prevention.
  • Sign agreements or contracts with third parties that provide specific benefits for the university community and promote university extension, cultural, sports, recreational and similar activities.
  • Enter into sponsorship and fund-raising agreements.
  • Sign sponsorship contracts.

Article 2. The following powers of the rector are hereby delegated to the general manager:

Concerning teaching and research staff:

  • Enter into contracts signed under Article 60 of the Organic Law on the University System whose purpose is to commission specific training activities from UPF lecturers.

Concerning technical, management, administration and services staff:

  • Appoint interim civil servants.
  • Sign the contracts of temporary administration staff, except senior management, and declare their termination.
  • Declare administrative situations, except the suspension of employment.
  • Launch, process and make decisions on fast-track disciplinary proceedings.
  • Issue all standard instruments and decisions concerning applications for staff positions, except those of calls.

Concerning economic and financial matters:

  • Authorize, introduce and recognize the obligation and order the payment of Chapter I expenses in relation to UPF staff.
  • The economic and financial powers to authorize, introduce, recognize obligations and order the payment of all other expenses.
  • Sign or authorize bank transfers, cheques or any other means for paying the expenses referred to above online.

Authorize the following amendments to credits:

  • Credit extension and generation.
  • Credit transfers for which responsibility is attributed to the rector under the bases for the implementation of the UPF budget.
  • Cancellation of loans.
  • Incorporation of the balance of liquid assets and liabilities.
  • Authorize requests to defer and split payments of debts.
  • Decide on cases of refund of income, including decisions on claims over public prices.
  • Sign credit assignments.

Concerning administrative procurement:

  • All actions attributed under the legislation on public sector contracts to the rector as contracting authority in contracts with an estimated value of €2,000,000.00 or less.
  • Adhere to central procurement boards and the contracts that these central procurement boards open for tender, as well as agree on the modification and termination of such adherence.
  • Sign joint procurement agreements with other contracting authorities or central procurement boards.
  • The assignment to in-house means and the approval of the rates applicable to these assignments.

By delegation of the rector, the general manager is mandated to represent the University in the following actions:

  • The signing of contracts under which the University undertakes to deliver movable property, rights or provide services.
  • The signing of concession contracts involving public domain assets and the exploitation of property assets, as well as lease agreements and other similar legal transactions involving real estate, marketable securities and intangible properties, in which the University acts as lessee or assignee.

Of a general nature:

  • Chair the Occupational Health and Safety Committee.
  • Sign institutional agreements with other public and private bodies and institutions in the scope of their powers, unless the signature of the rector is required.
  • Apply for grants or subsidies on behalf of the University from public or private bodies in the scope of their powers and handle the resulting documents.

Article 3. Requirements for resolutions issued by delegation

Any administrative decisions adopted by virtue of this delegation shall be deemed to have been issued by the rector and therefore exhaust administrative proceedings. The delegated powers include the issuing of the certificate of administrative silence and decisions on appeals lodged against proceedings initiated by delegation. The documents issued must bear the words “by delegation”, abbreviated to “p.d.”, in the signature, followed by the rank and the date of the decision.

The rector may take control of the powers delegated under this resolution for decisions on matters deemed appropriate thereby in accordance with Article 9 of Law 26/2010, of 3 August, on the legal system and the procedure for public administrations in Catalonia and Article 10 of Law 40/2015 on the legal regime of the public sector.

Sole repealing provision.

The resolution by the rector of 4 September 2024 on the revocation of powers assigned or delegated to the general manager and the resolution by the rector of 10 March 2023 on the delegation of powers to the general manger are hereby repealed.
