This course explores the “extraordinary” mechanisms of protection of fundamental rights, such as the individual complaint before the Spanish Constitutional Court and the complaints before the European Court on Human Rights. In both cases the course analyzes the admissibility criteria of these mechanisms and the effects of the judgments issued by the Spanish Constitutional Court and the European Court of Human Rights. The Charter of Fundamental Rights of the European Union is also a text of reference for the course, as well as the study of the preliminary reference procedure before the Court of Justice of the European Union. Moreover, the course pays attention to fundamental rights particularly relevant for lawyers and which as constitutional dimension: the freedom of expression of the lawyer during the judicial proceedings and the right to a fair trial.
