Additional provisions
One. Creation of new academic bodies
In the event of creating new centres, departments and university research institutes, the rector is authorised to appoint its acting dean or director and other provisional governing bodies, until they are structured in accordance with the provisions of these By-laws.
Two. Assignment of functions
In the event that, due to a lack of candidates in an electoral process, a dean or director cannot be elected for a centre or department, the record shall assign the relevant functions provisionally to a lecturer of this centre or department from among those who fulfil the requirements set out in the current legislation.
Three. Attachment of teaching and research staff to electoral colleges of corporate bodies
1. Doctor lecturers with a civil servant contract of the phased out teaching bodies of full university school professor and of tenured university school lecturers belong to electoral college letter a) of article 40.2 of these By-laws, regulating the make-up of the Board of Governors. Non-doctor lecturers with a civil servant contract of the teaching bodies, tenure-track lecturers with a civil servant contract of the teaching bodies, permanent non-doctor collaborating lecturers and temporary collaborating lecturers belong to electoral college letter c) of the aforementioned article.
2. Doctor lecturers with a civil servant contract of the phased out teaching bodies of full university school professor and of tenured university school lecturers belong to electoral college letter a) of article 43.2, regulating the make-up of the Senate. Non-doctor lecturers with a civil servant contract of the teaching bodies, tenure-track lecturers with a civil servant contract of the teaching bodies, permanent non-doctor collaborating lecturers and temporary collaborating lecturers belong to the teaching and research staff subsector which holds 5 % of letter b) of the aforementioned article.
3. Doctor lecturers with civil servant contract of the phased out teaching bodies of full university school professor and of tenured university school lecturers belong to electoral college letter a) of article 51.2m regulating the electoral sectors in the elections for rector. Non-doctor lecturers with a civil servant contract of the teaching bodies, tenure-track lecturers with a civil servant contract of the teaching bodies, permanent non-doctor collaborating lecturers and temporary collaborating lecturers belong to electoral sector letter c) of the aforementioned article.
4. Permanent foreign adjunct lecturers belong to the electoral colleges that correspond to full professors and senior lecturers.
5. Researchers associated to the University by means of an agreement with the Catalan Institution for Research and Advanced Studies (ICREA) belong to the electoral colleges that correspond to full professors and senior lecturers.
6. When in these By-laws it is required to hold a PhD in order to hold a position or belong to a corporate body, this shall be understood to refer to those categories for which the law or these By-laws require the qualification of doctor, which are currently as follow: full university professor, tenured university lecturer, full university school professor, contracted full professor, senior lecturer, teaching assistant, visiting lecturer, UPF or associate researcher, collaborating doctor, emeritus and doctor tenured university school lecturer.
Four. Full university school professors
Doctor full university school professors who apply to the rector may join the body of tenured university lecturers in the same positions as they hold, maintaining all of their rights, under the terms set out in additional provision one of Organic law 4/2007m of 12 April, amending Organic law 6/2001, of 21 December, on universities. Lecturers who do not make such a request shall remain in their current situation and shall conserve their full teaching and research capacity.
Doctor lecturers who remain in their positions as university school full professors may be members of the teaching staff competitive access or selection assessment committees and members of the teaching staff committees of the departments and of the University.
Five. Tenured university school lecturers
Tenured university school lecturers who when Organic law 4/2007, of 12 April, amending Organic law 6/2001, of 21 December on universities came into effect, held the qualification of doctor or who have obtained such qualification at a later date and are accredited within the framework of article 57 of the LOU, shall directly enter the teaching body of tenured university lecturers, in their own positions. The University shall establish programmes to help tenured university school lecturers combine their teaching tasks with obtaining the qualification of doctor. Those who do not become tenured university lecturers shall remain in their current situation and shall conserve their full teaching capacity and, when applicable, their research capacity.
Six. Current collaborating lecturers
Teaching staff who when Organic law 4/2007, of 12 April, amending Organic law 6/2001, of 21 December on universities came into effect were contracted as collaborating lecturers in accordance with the LOU, may continue to carry out their teaching and research functions until their contract expires. Temporary lecturers with an indefinite contract who held the qualification of doctor or who have obtained such qualification at a late date and are positively evaluated as referred to in section a) of article 52 of the LOU shall directly access the category of senior lecturer, in their own positions.
Seven. Collaborating lecturers
The University, in compliance with transitory provision two of Organic law 4/2007, of 12 April, amending Organic law 6/2001, of 21 December on universities and in the regulations approved by the State government, may exceptionally contract collaborators from among three-year degree holders, technical architects or technical engineers with the aim of covering qualified teaching needs in specific fields of knowledge. In order to be contracted, candidates must have a favourable report from the Quality Assurance Agency of the University System in Catalonia.
Eight. Teaching staff competitive access or selection assessment committees
University lecturers from other European Union member states who have held an equivalent position in those countries, under the terms set out in the current legislation, may be members of the assessment committees of university teaching bodies.
Retired lecturers of university teaching bodies may also be members of these committees.
Nine. Voluntary early retirement
In accordance with additional provision twenty-three of Organic law 4/2007, of 12 April, amending Organic law 6/2001, of 21 December on universities, the University shall promote, under the terms set out in the current regulations, access to voluntary early retirement or to agreements that lead to a progressive reduction in activity as of the age of 60 and voluntary retirement of university personnel.
Ten. Governing bodies
1. The amendment of the By-laws shall not alter the calculation of the mandate of currently constituted unipersonal governing bodies and of general corporate bodies of governance and representation. Partial elections that are to be held in these bodies in order to fill vacancies shall take place with the electoral colleges that comprise them at the time that the amendment is approved.
2. The Board of Governors shall adapt its composition in respect of sections 1 and 3 of article 40.2 prior to the end of the first term of the following academic year, by the time that remains until the end of the current mandate.
3. In the case of departmental and university research institute boards, they shall adapt their rules and regulations to the provisions of articles 61 and 63, respectively, prior to the second term of the coming academic year, and partial elections shall only be called at those colleges where vacancies remain as a result of the amendments made or in newly created electoral colleges, by the time that remains until the end of the current mandate.
Transitory provisions
One. List of teaching staff job positions
Until the first list of teaching staff job positions is approved, the University may call for applications for teaching staff positions and approve a provisional catalogue or list of positions.
Two. Permanent foreign adjunct teaching staff
The positions of permanent foreign adjunct teaching staff are declared to be eliminated. The teaching staff that holds these positions may choose between remaining in the position or taking up a position of professor or associated lecturer, as is fitting to his/her current category, as long as he/she obtains the relevant accreditation in accordance with the current regulations.
Three. UPF scales of the civil servant administration and service staff
Until the Board of Governors determines the UPF scales of the civil servant administration and service staff of Pompeu Fabra University, the following shall be applied:
- Group A:
Subgroup A1
Technical scale.
Optional scale of archives and libraries.
Subgroup A2
Management scale.
Scale of archive and library assistants.
- Group C:
Subgroup C1
Administrative scale.
Subgroup C2
Auxiliary administrative scale.
Professional groups:
Auxiliary services scale.
Final provisions
One. Deployment of the By-laws
It is the responsibility of the Board of Governors to approve any provisions that are required for the implementation and application of these By-laws.
Two. Validity
These By-laws shall come into effect on the day their publication in the DOGC.
