LA TRANSFORMACION DE LOS PRINCIPIOS LIMITADORES DEL IUS PUNIENDI EN EL MODERNO DERECHO PENAL ECONOMICO Y DE LA EMPRESA

The recent period of intense economic crisis has been -and is still being- a real "stress test" for the validity of the classic limits of ius puniendi in economic and corporate criminal law, which is observed both in the reforms laws of 2010 and 2015 as in the application of such principles by the criminal jurisdiction. In this sense, there are reasons to think that the intense political, media and citizen pressure to attribute responsibilities for the crisis could have led to a significant relaxation or adaptation of these principles in order to make possible the corresponding prosecutions and, in many cases, the consequent convictions. Starting from the previous hypothesis, and from the study of judicial resolutions (both from the Spanish, international and comparative criminal and constitutional jurisdiction), as well as from the analysis of the most relevant doctrinal contributions, the present project aims to confirm said transformation and determine its scope, as well as to critically assess in which cases we find ourselves before an adaptation of the limiting principles that deserves to be considered legitimate and justified from a criminal political point of view, and in which, on the contrary, we witness an unjustifiable transgression of the most basic criminal guarantees.

To this end, and more specifically, the project aims to analyze how basic principles such as legality (and all derived guarantees), culpability and proportionality (with guarantees linked as ultima ratio, exclusive protection of legal goods etc.), as well as procedural principles with substantive relevance in matters such as procedural agreements or the treatment of undue delays.
