The seminar aims to discuss and investigate the potential of comparative law to examine the functioning of legal institutions in a globalized world, in which the phenomena of integration, harmonization and transplantation of normative designs are kept in tension.

The proposal is to address the issues concerning what and how to compare. This requires analysing functionalist and cultural approaches, as well as their areas of contact with legal history, anthropology, constitutionalism, human rights, political philosophy, semiotics and language as conditions.

These developments will be combined with some alternatives offered by justice to achieve the protection of rights using comparison as the main methodology. The seminar aims to discuss and investigate the potential of comparative law to examine the functioning of legal institutions, in a globalized world, in which the phenomena of integration, harmonization and transplantation of normative designs are kept in tension.
